Is Barbequing On My Condo Balcony Legally Allowed?

The short answer is: "it depends". First, it depends on which municipality you live in. London, Mississauga, Ottawa and Toronto do not prohibit barbequing on the balcony of a condominium. Guelph does. That said, even if your municipality does allow barbequing on the balcony, your condominium corporation might not allow it.

Boards of condominium corporations are allowed to make rules to enhance the safety and security of the condominium community and under this authority can prohibit the use of barbeques on balconies. Alternatively, the original declaration forming the condominium corporation may prohibit this activity.

To ascertain whether you are allowed to legally barbeque on your condo balcony, first check with your municipality and then with your condo rules and declaration.
